This policy only applies to NBC merchandise offered for sale on NBC’s website and bought via the website (“NBC Product”). Thus, for example, it does not apply to purchase of NBC merchandise bought at the British Birdwatching Fair at Rutland Water, NBC membership or benefits made available to members from time to time (such as, copies of Cotinga).
This policy covers cancellation of purchase orders for NBC Product (excluding cases of faulty or mis-described goods).
This policy does not affect your legal rights. However, it does enhance certain of your legal rights as explained below. You can obtain information about your legal rights from your nearest Citizens’ Advice Bureau or Trading Standards Office.
Cancellation of purchase order for NBC Product
If you are a consumer the Consumer Contract Regulations 2013 (“CCR”) grants you a legal right to cancel your purchase (broadly speaking) within 14 days and claim a refund. CCR does not affect your legal rights in relation to faulty or mis-described goods.
(Broadly speaking under the Consumer Rights Act 2015, if any goods delivered to you are not of satisfactory quality, fit for purpose or as described, you have the right to request a refund for up to 30 days from the date you received the product. After 30 days and within the first six months of receiving the product, you are entitled to a repair or replacement -with the option of a refund if the repair or replacement was unsuccessful. Different rights apply after the first six months and for up to six years.)
NBC Cancellation & Refunds Terms
NBC is pleased to offer you enhanced cancellation and refund terms provided you comply with the terms below.
(1) Your right to cancel
You may cancel your purchase order for NBC Product within the “cancellation period”.
The cancellation period begins with the date on which NBC confirms your order.
The date on which the cancellation period ends depends upon whether you have bought (1) one NBC Product (not delivered in instalments); (2) one NBC Product delivered in instalments; or (3) a batch of NBC Products.
(1) If one NBC Product (not delivered in instalments) then the cancellation period ends 30 calendar days after the day on which you receive the NBC Product.
(2) If one NBC Product delivered in instalments then the cancellation period ends 30 calendar days after the date on which you receive the last instalment of the NBC Product.
(3) If a batch of NBC Products then the cancellation period ends 30 calendar days after the day on which you receive the last of the NBC Products in the batch.
(2) Exercising your right to cancel
To exercise your right to cancel you must let NBC know, that you have decided to cancel (“notice of cancellation”). To do this either email [email protected] or write to NBC at the Club’s official address in the UK as appears on the Club’s website. In either case you should explain that you wish to cancel your purchase order and provide sufficient information so that NBC can identify your order (for example by providing name, address, date of purchase and any purchase number).
To be effective your notice of cancellation must be sent within the cancellation period described above. Notice of cancellation sent by email is treated as the day you sent the email and notice of cancellation sent by post is treated as sent on the day you posted the letter to NBC.
(3) Return by you
If NBC Product has been delivered to you before you cancel your purchase order, you must return it to NBC at the Club’s official address in the UK as appears on the Club’s website. This must be done without undue delay and in any event no later than 14 calendar days after the date on which you let NBC know that you wish to cancel the purchase order. You will be responsible for the cost of returning the NBC Product (but this does not apply if the NBC Product is faulty or not as described).
NBC does not accept responsibility for any items returned to it and “lost in the post”. You are recommended to insure items returned to NBC for loss or damage.
(4) Refund to you
If you cancelled your purchase order in accordance with the term of this policy:
(a) NBC will refund the price you paid for the NBC Product. As permitted by law, NBC may reduce your refund to reflect any reduction in the value of the NBC Product, if this has been caused by your handling them in a way which would not be permitted in a shop. If NBC refunds the price paid before it is able to inspect the goods and later discovers you have handled them in an unacceptable way, you must pay us an appropriate amount; and
(b) NBC will refund any delivery costs you have paid to NBC, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method NBC offers (provided that this is a common and generally acceptable method); and
(c) NBC will make any refunds due within the following timescales:
(i) where you have received the NBC Product and NBC has not offered to collect it from you: 14 calendar days after the day on which NBC receives the NBC Product back from you or, if earlier, the day on which you provide NBC with evidence that you have sent the NBC Product back to NBC. (For information about how to return NBC Product to NBC see (3) above; or
(ii) where you have not received the NBC Product or you have received it and NBC has offered to collect it from you: 14 calendar days after you inform NBC of your decision to cancel the purchase order.
NBC will refund you via the credit or debit card used by you to pay.
